Memorandum of Understanding
on Cooperation
in the Field of Micro, Small and Medium Enterprises
between the Ministry of Small Scale Industries and Ministry
of Agro & Rural Industries of the Republic of India and
Ministry of Industry and Promotion of Private Sector of
Cote d'Ivoire
Ministry of Small Scale Industries and Ministry of Agro & Rural Industries of the Republic of India and Ministry of Industry and Promotion of Private Sector of Cote d'Ivoire (hereinafter referred to as the "Parties").
Desiring to develop micro, small and medium enterprises (MSMEs) in the respective countries.
Have reached the following understanding
ARTICLE – I
The Parties shall cooperate in the following areas on mutually agreed terms and conditions and in accordance with respective laws and regulations;
1. Capacity building for developing policy and institutional framework through exchange of experts for the development of micro, small and medium enterprises (MSMEs) in Cote d'Ivoire.
2. Carrying out industrial potential surveys and feasibility studies to identify thrust areas and opportunities for development of MSMEs in Cote d'Ivoire.
3. Promoting partnership projects and institution-to-institution and enterprise-to-enterprise cooperation between the two countries.
4. Providing training for improvement of managerial & technical skills for MSMEs.
5. Organising exhibitions and trade fairs in India and Cote d'Ivoire for marketing of products and small projects.
6. Exchanging business missions to help initiate technology transfer and sustainable business alliances between Indian and Cote d'Ivoire enterprises.
ARTICLE – 2
A Joint Committee, hereinafter referred to, as "Committee", shall monitor the implementation of this MoU. The Committee shall comprise representatives of the Ministry of Small Scale Industries and Ministry of Agro & Rural Industries on the Indian side and of the Ministry of Industry and Promotion of Private Sector on Cote d'Ivoire side. Each party shall inform the other about the composition of the member (s) of the Joint Committee from its side.
ARTICLE – 3
(i) The Committee shall meet in ordinary session, once in a year, in India or Cote d'Ivoire alternately, and in extraordinary sessions at the request of either party at any time,when necessary.
(ii) The Committee shall oversee formulation of programmes and plans of cooperation and monitor
the progress of implementation with the aims of strengthening relations and partnership between the two countries in the field of promotion and development of MSMEs.
ARTICLE – 4
The Parties shall regularly exchange information relating to micro, small and medium business enterprises, development opportunities and possibilities of partnerships and shall work towards their achievement.
ARTICLE – 5
The Parties may, by mutual consent, make amendments to this MoU. Any amendment shall enter into force under the same terms and conditions as required for the entry into force of this MoU.
ARTICLE – 6
Any dispute between the Parties arising out of the interpretation of this MoU shall be settled amicably through consultation or negotiation between the parties and through diplomatic channels.
ARTICLE – 7
This MoU shall enter into force upon signature by both the parties and shall remain in force unless it is terminated by either party giving a 90 days written notice to the other party through diplomatic channels, indicating its intention to terminate this Memorandum of Understanding.
ARTICLE – 8
Termination of this MoU shall not affect the completion of any project undertaken pursuant to this MoU prior to its termination, unless the parties agree otherwise. IN WITNESS WHEREOF, the following representatives duly authorized thereby by their respective Governments have signed this MoU.Signed at New Delhi on this 14th day of February 2007 in two originals in English, Hindi and French languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
